These Terms of Service ("Terms") govern your use of the FoodKnower mobile application ("App") and website ("Service") operated by FoodKnower ("we", "us", or "our"). By using FoodKnower, you agree to these Terms.

1. Acceptance of Terms

By accessing or using FoodKnower, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Service Description

FoodKnower is a mobile application that uses artificial intelligence to identify food from photographs and provide informational scores related to food processing levels and overeating risk. The Service also provides nutritional information sourced from the Open Food Facts database.

3. Accounts

To use FoodKnower, you must sign in with a Google account. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must not share your account credentials with others.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the Service or servers.
• Circumvent rate limits or other usage restrictions.
• Use automated systems or bots to access the Service.
• Transmit content that is harmful, offensive, or violates the rights of others.

5. Intellectual Property

The FoodKnower application, including its design, scoring algorithms, and original content, is the intellectual property of FoodKnower. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.

6. Disclaimers

The scoring system used in FoodKnower is a custom, non-scientific system created by the developer. It is not endorsed by any regulatory body or scientific institution.

Scores are illustrative and have not been clinically validated. They are intended to help you think about food choices, not to provide medical or dietary advice.

FoodKnower is not a substitute for professional dietary or medical advice. Always consult a qualified healthcare professional for health-related decisions.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Food identification results will be accurate or complete.
• Nutritional information will be accurate, as it is sourced from third-party databases.
• Scores or results will be suitable for any particular dietary or medical purpose.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FoodKnower shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any dietary, health, or medical decisions made based on information provided by the Service.
• Any unauthorized access to or use of our servers.
• Any errors or inaccuracies in food identification, scoring, or nutritional data.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Third-Party Services

FoodKnower integrates with third-party services including Google Sign-In and AI language-model providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

10. Data Sources

Packaged food data is provided by Open Food Facts (openfoodfacts.org), available under the Open Database License (ODbL). Data has been modified from the original. We do not guarantee the accuracy or completeness of this data.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
